The FCC has adopted an Eighth Report and Order that will allow the 4.9 GHz Nationwide Band Manager to apply for a nationwide overlay license and enter into a spectrum sharing agreement with FirstNet, using unassigned spectrum in the band. The Commission has also declined to adopt rules establishing a leasing framework for non-public safety operations based on the stated divided record. For now, the Nationwide Band Manager will have the responsibility to facilitate non-public safety leasing through its overall status review of the band as part of its annual reporting requirement.
