Eleventh Circuit Upholds FCC Declaratory Ruling on 911 Fee Parity

The U.S. Court of Appeals for the Eleventh Circuit has affirmed the findings of a Federal Communications Commission declaratory ruling made in 2019 that the 911 Fee Parity provision prohibits states and local governments from charging 911 fees to VoIP providers that are greater than those charged to non-VoIP providers for the same amount of burden on 911 services.  The petitioners sought an appellate review of the FCC’s decision, which was based upon an interpretation of the NET 911 Act of 2008.
