The Federal-State Joint Board on Jurisdictional Separations has issued a Public Notice seeking comment on various comments and questions related to the FCC’s Part 36 separations rules as the Joint Board responds to a referral from the FCC. The jurisdictional separations rules prevent rate-of-return ILECs from recovering the same costs from both interstate and intrastate jurisdictions and were purposed with ensuring that these carriers apportion costs of their regulated services based on the relative use of their networks to provide services. The FCC has asked the Joint Board whether the separations rules are still needed and whether it would recommend a permanent separations freeze, among other issues.
Comments on this Public Notice are due 30 days after Federal Register publication, which has not yet occurred, and reply comments are due 45 days after Federal Register publication.
