The FCC has issued a Letter Order denying Hilliary Acquisition Corp 2016, LLC’s (Hilliary) request that the FCC refund monies that Hilliary has on deposit with the Commission in connection with Auction 105.  Hilliary had deposited a total payment of over $841 thousand with the FCC but was held to have defaulted on its 42 winning bids due to a late-submitted down payment.  The FCC’s Auctions Division of the Office of Economics and Analytics and Mobility Division of the Wireless Telecommunications Bureau assessed Hilliary an interim default payment of over $161 thousand and will assess a final default payment after license(s) for the covered spectrum receive winning bids in a future reauction, despite currently lacking spectrum auction authority.  The Commission denied Hilliary’s request for a refund of its remaining monies on deposit to ensure the eventual payment of Hilliary’s final default amount.
