On December 13, 2023, the FCC adopted the Second Text Blocking Report and Order (Report and Order). The Commission adopted a new rule that clarifies that prior express written consent under the Telephone Consumer Protection Act must be to one seller at a time. The Report and Order provided that such rule would become effective 12 months after publication in the Federal Register or 30 days after notice that the Office of Management and Budget (OMB) has completed its review of any information collection requirements, whichever is later. The rule was published in the Federal Register on January 26, 2024. OMB approved the information requirement on September 26, 2024. As such, the rule’s effective date is January 27, 2025, 12 months after the rule’s publication in the Federal Register.
