FCC Sets Pleading Cycle for Challenge to Wireless E911 Vertical Location Accuracy Requirements

The Federal Communications Commission’s (FCC or Commission) Public Safety and Homeland Security Bureau (Bureau) has issued a Public Notice announcing the filing of a Petition for Reconsideration (Petition) filed by Boulder Emergency Telephone Service Authority (BRETSA). The Petition was in response to the Fifth Report and Order in the Wireless E911 Location Accuracy Requirements proceeding. BRETSA argued that the Commission’s decision to decline to adopt proof of performance testing at locations where carriers will already be required to provide Z-axis location data was arbitrary and capricious and an abuse of discretion. Furthermore, BRETSA urged the Commission to require wireless providers to publish procedures for first responders to conduct tests of vertical location accuracy.

The Public Notice announced deadlines for oppositions to the petition.  Oppositions must be filed no later than 15 days after publication of the Public Notice in the Federal Register, which has yet to occur, and replies to oppositions must be filed no later than 25 days after publication of the Public Notice in the Federal Register.
