The FCC has adopted a Mobility Fund Phase II (MFII) Order on Reconsideration, addressing several petitions for reconsideration filed regarding the program’s structure. The Commission reconsidered its decision to use Form 477 data as the basis for determining areas presumptively eligible for MFII support, and instead imposed a new, one-time data collection to determine the 4G LTE deployment for the purposes of the MFII challenge process. The Commission also affirmed its decisions to utilize a 5 Mbps download speed benchmark, and to not consider incompatible technologies or collocation when determining an area’s funding eligibility.
