The U.S. Court of Appeals for the District of Columbia Circuit denied a petition for review of the Federal Communications Commission’s (FCC) decision to grant retroactive waivers of the Hearing Aid Compatibility (HAC) handset requirements to some wireless carriers while denying waivers to three carriers (CTC Telecom, Farmers Cellular Telephone Company, and Blanca Telephone Company of Colorado) which the FCC found did not exercise reasonable diligence in their efforts to comply with the HAC requirements. The FCC found these carriers did not exercise reasonable diligence because they had not complied by January 1, 2007, while most other carriers were in compliance by that date, and they did not seek compliant wireless telephones from entities beyond their existing vendors.
