NTIA and FirstNet Seek Comment on Key Aspects of Network’s Design, Deployment and Administration

The National Telecommunications and Information Administration (NTIA), together with the First Responder Network Authority (FirstNet), has released a Second Notice (Second Notice) seeking public comment on certain proposed interpretations of the Middle Class Tax Relief and Job Creation Act of 2012 (FirstNet Act), that will inform, among other things, network policies, forthcoming requests for proposals and interpretive rules surrounding NTIA and FirstNet’s rights and obligations under the FirstNet Act.  Specifically, the Second Notice makes preliminary conclusions on a range of issues, including the equipment for use on the FirstNet network, the nature and application of FirstNet’s required network policies, FirstNet’s presentation of “state plans”, a state plan’s impact on the rights and duties of other stakeholders, and the rights of states choosing to assume responsibility to build and operate a radio access network (RAN).   Comments are due by Monday, April 13, 2015.
