The FCC’s 2018 Declaratory Ruling, Report and Order and Order largely repealing the so-called “Open Internet” regulatory framework implemented by the prior FCC Chairman in 2015, will become effective on June 11, 2018, as notice was published in today’s Federal Register. The FCC’s ruling enhanced the network transparency requirements, and among other things, restored the classification of broadband Internet access service as an information service, reinstated the private mobile service classification of mobile broadband Internet access service and repealed conduct rules. The enhanced transparency requirements require Internet Service Providers (ISPs) to prominently disclose network management practices, performance, and commercial terms of their broadband Internet access service via a publicly available, easily accessible website or through transmittal to the Commission.
