FirstNet Opt-Out Notifications for 52 States and Territories Due By December 28, 2017

The FCC’s Public Safety and Homeland Security Bureau has released a public notice announcing the commencement of a 90-day period wherein each state or territory’s governor or duly appointed representative must elect whether to opt-out of FirstNet.  On September 29, 2017, FirstNet notified the Commission that 52 state and territories received the required statutory notice.  This notification kicked-off the 90-day opt-out decisional period in which FirstNet, NTIA and the FCC must receive formal notice of a state or territory’s decision.   Specifically, states and territories have until December 28, 2017 to submit an opt-out notification.  Such an election must reference PS Docket No. 16-269 and be filed via the dedicated email address opt-out@fcc.gov or via certified mail.
