The FCC’s 2017 Restoring Internet Freedom Order, which essentially overturned the entirety of its 2015 Open Internet Order that had established a Title II-based broadband regime, has been published in the Federal Register and given an effective date of April 23, 2018. This effective date provides a timeline for the order’s provisions to kick in and for parties seeking to challenge the order. Consumer groups and many State attorneys general are planning to file suit arguing, among other things, that the FCC’s decision was not based on objective data or feedback from experts or the public.
