FCC Proposes Rules for AI-Generated Robocalls, Robotexts

The FCC has adopted a Notice of Proposed Rulemaking and Notice of Inquiry aimed at protecting consumers against the use of AI in robocalls and robotexts.  The proposed rules would establish a definition for what qualifies as an AI-generated robocall or robotext, and would require callers to disclose their intent to use AI-generated calls and text messages when obtaining express prior consent from consumers.  Callers would be required to disclose to consumers during each AI-generated call.  The rules would exempt the use of AI-technologies to help persons with disabilities communicate by phone.  The FCC seeks comment on each of these issues.  Additionally, the Notice of Inquiry requests comment on developing technologies that may alert consumers to AI-generated unwanted and illegal calls and texts.
