The FCC’s Enforcement Bureau (Bureau) has issued a Public Notice notifying all U.S.-based voice service providers of a large amount of apparently unlawful robocalls transmitted by DigitalIPvoice, Inc. (DigitalIPvoice). The Commission has notified all U.S.-based voice service providers that if DigitalIPvoice fails to mitigate the identified traffic discussed in a cease-and-desist letter (CDL), which the Bureau has issued contemporaneously, U.S.-based voice service providers may block voice calls or cease to accept traffic from DigitalIPvoice, without liability under the Communications Act of 1934, as amended, or the FCC’s rules. Pursuant to the CDL, DigitalIPvoice must: (1) promptly investigate the traffic identified in the CDL; (2) block the identified traffic; and (3) report the results of the investigation to the Bureau.
