FCC Issues NALs for Failure to File BDC Data

The FCC’s Enforcement Bureau has issued Notices of Apparently Liability to nine companies for failing to file mandatory broadband availability and subscription data in the FCC’s Broadband Data Collection system following multiple notices by the Commission.  All facilities-based providers of fixed or mobile broadband internet access service are required by the FCC to submit availability and subscription data into the BDC system biannually. 

The FCC proposes a forfeiture of $30,000 against eight of the companies for failure to file their BDC data: Particle Communications Wholesale, Inc., National Telecom, LLC, Lobo Internet Services, Ltd., Antelecom, Inc., SignalNet Inc., Sonic Spectrum, Inc., BySky Inc., and Centex Web Access.  One company, Mobile Communications LLC was only assessed a $15,000 penalty as it was alleged that it only missed one BDC report, as opposed to the other eight companies who allegedly missed two BDC reports.
