The FCC has dismissed and denied SES Government Solutions’s (SES-GS) Petition for Reconsideration of the FCC’s 2017 decision, which clarified the Universal Service Fund (USF) government-only exemption. The exemption excludes entities that only provide service to government and public safety entities from the requirement to contribute to the USF fund. SES-GS’s Petition put forth several arguments including that the FCC decision created substantial confusion concerning the scope of the exemption and was irrational. The FCC has dismissed the Petition for failure to identify any error or basis for reconsideration and in the alternative, has denied the Petition on the merits.
