The FCC’s Enforcement Bureau has determined in part that Duke Energy Florida (Duke Energy) charged AT&T Florida (AT&T) unjust and unreasonable rates to use Duke Energy’s poles. AT&T previously claimed that Duke Energy was using an incorrect formula to calculate pole attachment rates, resulting in overcharges, for which AT&T sought reimbursement. The Enforcement Bureau clarified the pole attachment rate that should have applied to AT&T, based on FCC precedent, and that AT&T is entitled to a refund for overpayments made under the erroneous pole attachment rate.
