The Federal Communications Commission’s (FCC, Commission) Wireline Competition Bureau (WCB) has denied a petition for waiver from the Connect America Fund (CAF) Phase II Coalition (Coalition), which asked the FCC to modify the CAF II Eligible Locations Adjustment Process (ELAP). Specifically, the Coalition asked for relief “from certain evidentiary burdens associated with the Commission’s challenge process for facilitating adjustments to the defined deployment obligations of Phase II auction support recipients in situations where the number of funded locations is greater than the number of locations qualifying for support.”
Because WCB believed the Coalition’s petition should have been submitted as a Petition for Reconsideration, WCB dismissed the petition as procedurally deficient. WCB also dismissed the Coalition’s petition on the merits, as having failed to demonstrate good cause for a waiver.
