The Federal Communications Commission (FCC or Commission) has voted to adopt its draft Declaratory Ruling and Second Notice of Proposed Rulemaking (FNPRM). The Declaratory Ruling finds that the Commission has already fulfilled its obligation, under the Secure Networks Act, to prohibit the use of federal subsidies for covered equipment and services through its adoption of the November 2019 Supply Chain Order. The Second FNPRM seeks comment on integrating Sections 2, 3, 5, and 7 of the Secure Networks Act into its existing supply chain rulemaking proceeding. Specifically, the FCC seeks comment on: (1) creating and maintaining a list of covered equipment and services; (2) banning the use of federal subsidies for equipment and services on the list; (3) implementing reporting requirements for providers replacing such equipment and services; and (4) taking potential enforcement actions against providers who fail to follow the rules.
