Congress, FCC Consider Small Internet Service Provider Transparency Exemption

Senators Steven Daines (R-MT) and Joe Manchin (D-WV) have reintroduced the Small Business Broadband Deployment Act in the U.S. Senate. This legislation mirrors legislation passed in the House earlier this month (H.R. 288). It would extend the small ISP exemption for five years from the date of enactment, with small ISPs defined as those with no more than 250,000 subscribers.

Last month, the small business exemption from the Open Internet Order’s expanded reporting requirements expired. The FCC is also currently considering this matter, with Chairman Pai circulating a draft Order that mirrors both pieces of legislation.
