Comment Sought on Flexible Use of 800 MHz Commercial Air-Ground Bands

The FCC’s Wireless Telecommunications Bureau (Bureau) is seeking comment on Gogo Business Aviation LLC’s (Gogo) Petition for Rulemaking requesting that the Commission revise the rules for the 800 MHz Commercial Air-Ground Service to enable more flexible use of the bands.  The Bureau is specifically seeking comment on Gogo’s proposal that the Commission regulate effective radiated power (ERP) by average power with an appropriate peak-to-average ratio (PAR) limit, instead of peak power as Section 22.867 of the FCC’s rules currently specifies.   The Commission also requests comment on: (1) the three rules that Gogo proposes removing (sections 22.853, 22.859, and 1929(e)(2) of the Commission’s rules); and (2) four rules that Gogo proposes amending (sections 22.165(f), 22.313, 22.861, and 22.863 of the Commission’s rules).  Comments are due July 22, 2024, and reply comments are due August 6, 2024.
