CGB Clarifies Reassigned Numbers Database Safe Harbor

The FCC’s Consumer and Governmental Affairs Bureau has released a Public Notice supplementing previous guidance on the Reassigned Numbers Database (RND) to clarify that callers may be eligible for a safe harbor under the Telephone Consumer Protection Act if an authorized agent queries the RND on their behalf.  The RND is a comprehensive database that allows callers to ensure that they have reached consumers that expect their calls and avoid calling consumers who do not wish to be called.

Although, callers and agents were previously permitted to query the database it was unclear whether a caller would be eligible for the safe harbor if the agent made the query on behalf of the caller.  The Bureau now clarifies that callers may rely on a query made by an agent on its behalf if it authorized its agent to do so prior to the call.
