The Sixth Circuit U.S. Court of Appeals has granted a temporary two-week stay of the FCC’s Net Neutrality Order. The stay delays the effective date of the Net Neutrality Order from July 22 to August 5 while the court considers the merits of the appellants’ motion for a long-term stay of the order. The federal appeal of the Net Neutrality Order was brought by the Ohio Cable Telecommunications Association among many other broadband industry representatives, and landed in the Sixth Circuit by a venue lottery system. During the temporary stay, the court also requested that the parties submit supplemental briefs relating to the 2005 Brand X Supreme Court case that first established classifying Internet services as either “information services” under Title I of the Communications Act or “telecommunications services” under Title II.
